Federal-Aid Domestic Materials Update

The Federal Highway Administration (FHWA) is hosting a free webinar to review "Phase 2" of the Manufactured Products Final Rule.

On January 14, 2025, FHWA terminated its 1983 Manufactured Products General Waiver, which excluded manufactured products from coverage under FHWA’s Buy America requirements, after determining the waiver was no longer appropriate (90 FR 2932, Manufactured Products Final Rule).

The Manufactured Products Final Rule also established standards regarding Buy America requirements applicable to manufactured products on Federal-aid projects and a phased schedule for implementing those standards:

The rule was rolled out in two phases:

  • For projects obligated on or after October 1, 2025, final assembly of all manufactured projects must occur in the U.S.

  • For projects obligated on or after October 1, 2026, in addition to the final assembly requirement, the cost of components of products that are mined, produced, or manufactured in the U.S. must be greater than 55 percent of the total cost of all components of the manufactured product.

The Build America, Buy America (BABA) Act requires that all of the iron, steel, manufactured products, and construction materials used in federally funded infrastructure projects be produced in the United States.

BABA builds upon previous Made in America policies to help bolster America's industrial base, protect our national security, and support high-paying jobs.
