Overview of USACE Section 404 Regulatory Program

CALTAP is pleased to host this 1-hour webinar presented by the U.S. Army Corps of Engineers (USACE) and Caltrans Office of Environmental Compliance & Outreach (ECO), on the USACE regulatory program for Clean Water Act Section 404.

Under Section 404 of the Clean Water Act of 1972, USACE has authority and responsibility to regulate discharges of dredged or fill material into the “waters of the United States”. Examples generally include:

  • Fill required for construction of any structure or creation of ponds
  • Impoundment requiring rock, sand, dirt, or other material for its construction
  • Site-development fills for recreational, industrial, commercial, or residential uses
  • Causeways or road fills, dams & dikes, and artificial islands
  • Property protection or reclamation devices (riprap, groins, seawalls, etc.)
  • Beach nourishment, levees, fill for intake/outfall pipes & subaqueous utilities
  • Any other work involving the discharge of fill or dredged material

A USACE permit is required whether the indicated work is permanent or temporary, with examples of temporary discharges including dewatering of dredged material prior to final disposal, and temporary fills for access roadways, cofferdams, storage and work areas.

CWA Section 404

Section 404 of the Clean Water Act requires authorization from the Secretary of the Army, acting through the Corps of Engineers, for the discharge of dredged or fill material into all waters of the United States, including wetlands.

A Corps permit is required whether the activity is ongoing or temporary.
